SALES AGREEMENT
On agreed upon Date of Sale and upon full payment of said goat(s) as set forth in contract above, SELLER agrees to provide ADGA registrations papers and transfer of ownership form(s) to BUYER. BUYER agrees to complete the full transfer of ownership through ADGA at BUYER'S expense within 30 days of date of sale. (Castrated goats will NOT come with ADGA registration papers & will NOT be tattooed)
1 SELLER warrants clear title to said goat(s).
2 SELLER makes NO other guarantees, expressed or implied, including any guarantees to health, color, height, reproduction, show quality, milk production, etc. We do not offer any health or wellness guarantees after the goat has left our property since we cannot control the management of said goat(s) once it leaves our farm. We encourage BUYERS to understand that travel and management change is stressful to said goat(s) and the BUYER is encouraged to make environment & feed transitions slowly to reduce stress to said goat(s).
3 SELLER guarantees said goat(s) is healthy at time of sale and BUYER has the option to review the condition and health of the goat, including any veterinary examinations, at BUYER’s expense.
4 Kids sold as breeding stock are guaranteed free of genetic defects causing infertility. Should a kid sold as breeding stock be found infertile, due to a clearly identificable congenital defect, we will replace the kid or doe with another kid of the same gender, as soon as one becomes available. We will extend this guarantee to include genetic teat defects for animals sold as breeding stock, as some teat defeats do not manifest until puberty. We MUST be notified of a suspected teat defect prior to the animals’s FIRST birthday. We MUST be notified there is a concern the animal may have a congenital defect affecting fertility prior to animal’s THIRD birthday. This animal must be considered sterile to be a defect. Failure to do so voids the above stated guarantee. Proof of exam and statement from a licensed veterinarian, which must include on the statement ear tattoo were read by veterinarian, documented and matched with ADGA registration papers, and that the defect is congenital and/or was present at birth, and is the cause of the infertility. For a teat defect, the veterinarian must include statement ear tattoos read, document, and matched ADGA registration papers, and a statement confirming presence of the teat defect. A copy of the veterinarian’s finding report must be submitted to us within 30 day’s of the veterinarian’s findings. This guarantee does NOT apply to animals designated as a pet on the sales agreement whether with or without papers, wethers, or does with an existing teat defect at time of purchase. We will work with the buyer in such cases to provide comparable replacement; however, the final choice and selection of the replacement will reside with the breeder. The buyer will be responsible for any transportation costs and transportation related costs (such as health certificates) for the replacement animal.
5 All buck & doe kids will be disbudded, tattooed, vaccinated twice for CD/T and registered with ADGA before leaving
Iridescent Acres. All wethers will be disbudded, vaccinated, and castrated before leaving Iridescent Acres, unless other arrangements have been made.
6 Should a doe be sold as a pet/non-breeding animal, no registration papers will be released or given to BUYER at any time.
7 Iridescent reserves the right to retain any kid from any breeding at any time
8 BUYER has the right to review current blood test results, DHI milk test results, and Linear Appraisals.
9 Reservations require a non-refundable deposit (1/2 purchase price) accompanied by this signed contract.
10 Deposits are non-refundable unless BUYERS reservation cannot be filled.
11 If the BUYER’S first choice kid is not available, BUYER has the option to choose a kid from another breeding OR choose to
have their deposit refunded in full within 30 days or rolled over to the following year.
12 Reserved kids must be picked up within 7 days of the agreed upon sale date. Reserved goats not picked up within 7 days of the agreed upon sales date will be charged $5/day board, to be paid by BUYER before goat leaves the farm. If said goat(s) is not picked up within 14 days of the agreed upon sales date the BUYER’S reservation will be forfeited, including all monies paid, and said goat(s) will be retained or placed for sale.
13 In the event of the loss or injury of said goat(s) prior to delivery date to BUYER, SELLER shall refund full deposit to
BUYER.
14 Reserved goat(s) will not leave Iridescent Acres, for any reason, until full payment is received.
15 Any animals sold bred are not guaranteed pregnant, as we have no control over the care of pregnant doe after it leaves the farm. Buyer is welcome to pay for ultrasound/blood confirmation before leaving farm to confirm pregnancy at time of sale. Seller offers no guarantee as to quality or number of kids born. Seller has no control over abortion, absorption or loss of fetus, or overall health of kids and/or doe after transfer to Buyer due to stress, management, natural causes, etc. Breeder only guarantees witnessing the breeding.
16 Any kids who are the result of a doe purchased bred MUST carry the “Iridescent” herd name and have ear tattoos of the farm where the the kids were actually born (BUYERS tattoo letters).
17 Any animals sold out of state or flying require a Health Certificate in order to be transported across state lines per STATE LAW. Health certificates will be arranged by Seller at Buyer’s request, and must be paid for by Buyer ($TBD) in addition to the reservation deposit.
18 All of our animals are well care for and provided appropriate, shelter, food, veterinary care, etc. We expect our buyer’s to do the same. At minimum a 3 sided shelter out of the wind and rain is required for shelter and goat appropriate 4’ fencing that protects them from predators. No goats will be tied out, this is dangerous for multiple reasons and we do not sell our goats as brush control. We reserve the right to refuse any sales if we do not feel it is in the animal’s best interest. Buyer must be prepared prior to pickup of animal with all of the above. We do not sell to homes with only 1 goat and will offer a companion goat if available and if not are happy to refer buyer to other potential companions.
19 All animals must be picked up in a safe and humane way, preference is an appropriate sized dog crate or enclosed trailer. Tying them up is not an option.
20 We reserve the right to refuse a sale and return the money (minus any health certs/etc for specific sale) at any time.
Upon breach of this AGREEMENT by one party the other party shall have the option to terminate sale. This AGREEMENT shall be governed by the laws of the State of Washington, County of Pierce.
